Direct Hiring vs. Licensed Agency Deployment: Legal Risks for Foreign Employers

direct hiring of Filipino workers, international recruitment partner in the Philippines

Filipinos work in almost every country. Government data show about 2.19 million Filipinos worked abroad in 2024. Some foreign employers want to skip their international recruitment partner in the Philippines. They hire workers directly. In most cases, Philippine law says no.

The Direct Hiring Ban

The rule is short. Article 18 of the Labor Code bans direct hiring of Filipinos for work abroad. The DMW’s own guidance lists a few exceptions. They cover diplomats, international groups, and top government officials. Some relatives who live abroad also qualify. Everyone else must use a licensed agency. Skip that step, and the government will not process the worker’s contract. That leaves your hire undocumented.

What Illegal Recruitment Costs

The penalties are tough. Under Republic Act 10022, illegal recruitment brings 12 to 20 years of imprisonment. The fine runs from ₱1 million to ₱2 million. Large cases are worse. A group of three or more can commit it. Or it can hurt three or more people. Either way, the law calls it economic sabotage. The penalty is life imprisonment and a ₱2 million to ₱5 million fine.

The law targets people or organizations with no license. It does not target a real and DMW-accredited overseas employment agency in the Philippines. Still, an unlicensed agent can leave your hires without valid papers.

Shared Liability Through a Licensed Agency

A licensed agency gives you a legal path. You still have duties, though. The Philippine law makes you and the agency both liable for worker claims. A worker can seek the full amount from either one. The agency’s bond helps cover it. Fire a worker without cause, and you may owe back fees plus 12% interest.

You may also owe pay for the rest of the contract, up to three months for each year left. A final court loss bars you from hiring Filipinos until you pay. You must also file a recruitment agreement and job order for review. A licensed overseas recruitment agency can handle that step.

Choosing a Safe Path

Two checks can protect you. First, look up any agency on the DMW list of licensed agencies. Second, ask about fees. The ILO’s fair recruitment principles say workers should never pay to get hired. Pick an ethical recruitment partner in the Philippines that passes both tests.
